      Al tratarse de un contrato privado, y según dispone el Artículo 21 del Trlcsp, el orden jurisdiccional civil será el competente parea resolver las controversias que surjan entre las partes en los contratos privados. No obstante se considerarán actos jurídicos separables los que se dicten en relación con la preparación y adjudicación del contrato, y en consecuencia, podrán ser impugnados ante el orden jurisdiccional contencioso administrativo de acuerdo con la normativa reguladora de dicha jurisdicción, no obstante, serán susceptibles de recurso especial en materia de contratación, previo a la interposición del contencioso administrativo, los actos referentes al presente contrato relacionados en el Art. 40.2 del Trlcsp. El órgano competente para resolver dichos recursos es el Tribunal Administrativo de Recursos Contractuales del Excmo.
