      2. Lodging of appeals
         

         A) Contra este acuerdo, potestativamente, podrá interponerse recurso de reposición, ante el mismo órgano que lo dictó, conforme lo dispuesto en el Artículo 123 y ss. de la Ley 39/2015, de Pacap, en el plazo de un mes a contar desde el día siguiente al de su notificación y, contra la resolución expresa o presunta de éste, recurso contencioso-administrativo ante el Juzgado de lo Contencioso-Administrativa de Vitoria-Gasteiz, en el plazo de 2 meses, a contar desde el día siguiente al de la notificación de la resolución desestimatoria del recurso o en el plazo de 6 meses a contar desde el día siguiente a aquel en que se produzca la desestimación presunta del recurso.

         b) Directamente recurso contencioso-administrativo ante el Juzgado de lo Contencioso-Administrativa de Vitoria-Gasteiz, en el plazo de 2 meses contados a partir del día siguiente al de la notificación.

         c) En los supuestos previstos en el Artículo 37 del Trlcsp, se podrá plantear la interposición de la cuestión de nulidad contractual, en el plazo de 30 días hábiles, en los términos previstos en el Artículo 39 del Trlcsp.

         Todo ellos sin perjuicio de que los interesados puedan ejercitar, en su caso, cualquier otro que estimen procedente conforme a lo previsto en el Artículo 40.2 de la Ley 39/2015, de Pacap.
